The person who first applies for an exploration permit in accordance with section 34 of the Mining Act (621/2011) is given priority with respect to the granting of the permit. The permit application must include all verifiable clarifications required with respect to consideration of the permit in all sections of the application, as provided under section 34 of the Mining Act (621/2011).
For the purpose of preparing an application for an ore prospecting permit, an applicant may reserve an area for itself by submitting a notification (reservation notification) on the matter to the mining authority. Priority with respect to a reservation notification becomes valid once the reservation notification has been submitted in compliance with the provisions laid down in section 44 of the Mining Act and no reason exists, as specified in the Act, for the rejection of the reservation.
If the ore prospecting permit application is incomplete and fundamentally flawed, another party making a reservation notification in accordance with section 44 of the Mining Act may be granted priority in obtaining the permit in question.
