The term ‘economic operator’ refers to a manufacturer, authorised representative, importer or distributor.
The Construction Products Regulation (305/2011) defines the various economic operators as follows:
Manufacturer = any natural or legal person who manufactures a construction product or who has such a product designed or manufactured, and markets that product under his name or trademark
Authorised representative = any natural or legal person established within the EU who has received a written mandate from a manufacturer to act on his behalf in relation to specified tasks
Importer = any natural or legal person established within the EU who places a construction product from a third country on the EU market
In interpretation, according to the Construction Products Directive, an importer refers to any natural or legal person who places a construction product on the Finnish market.
Distributor = any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a construction product available on the market
- ‘making available on the market’ means any supply of a construction product for distribution or use on the EU market in the course of a commercial activity, whether in return for payment or free of charge;
- ‘placing on the market’ means the first making available of a construction product on the EU market.
