New authorisation and non-inclusion decisions
Following a risk assessment and comments by the EU Standing Committee on Biocidal Products (SCBP), a decision is made for an active substance inclusion. Decisions are made specifically for each substance and product type and published as Commission Directives or Regulations. In Finland these inclusion directives for active substances are incorporated into national legislation under the Ministry of the Environment Decree 20/2008 and amendments to it. The up-to-date decree can be found in the online legislation database (www.finlex.fi) in Finnish and Swedish. Substance specific implementing regulations are published in the Official Journal of the European Union.
The European Commission has taken non-inclusion decisions under which the placing on the market and use of named active substances is prohibited. Such substances must be removed from biocidal uses on the market within 12 months of the entry into force of the relevant decision. Details of non-included active substances can be found in Commission's webpages. The decisions also specify the product types to which the decision pertains and the dates by which products containing these active substances must be removed from the market.
